Temporary personnel now subject to explicit legal regulation

Bulgarian Parliament adopted amendments to the Labour Code, implementing the EU Directive 2008/104/EC for provision of personnel by temporary work agencies.

According to the newly adopted regulations, temporary work agencies shall be subject to mandatory registration. The employers can avail from the temporary work (rented personnel) solutions for accomplishment of particular works (until completion) or for replacement of absent employees.

These regulations are aimed to establish a relatively new type of tripartite employment relations. Whilst the structures in question are known to the employers, adequacy of the new regulations is yet to be tested in the light of the current labour market specifics. Therefore, a careful legal review of the temporary personnel agreement concluded between the agency and the employer remains highly recommendable.
